Building Code Board of Appeals - established by the Town Council on June 27, 1977, in accordance with the State Building Code to hear appeals from aggrieved parties regarding the interpretation, requirements, direction or failure to act under the State Code by the Building Official.
The Town Council appoints members to the Board for five-year terms. Effective July 1980, new membership on the Board is specified by State procedures. The Board shall consist of one architect, two professional engineers, one builder, and a building official (or member of the general public). Persons sitting on the Board prior to 1980 may be reappointed; however, new appointees must meet the above criteria.
The Board of Appeals meets regularly throughout the year, to hear appeals of decisions made by the Building Official (usually 3-4 times/year).
Minimum Housing Board of Appeals - authorized to hear and decide appeals from compliance as noted in the Minimum Housing Code.
The Board shall have the power to reverse or affirm wholly or partly or to modify any order of the Chief Inspector and in specific cases to authorize such variance in the application of the terms of this Ordinance, where owing to unusual conditions a literal enforcement of the provisions of the Ordinance will result in unnecessary hardship, and so that the spirit of the Ordinance shall be observed and substantial justice done.
